Why Trademark Registration in the Zanzibar Is Important for Brand Protection?
Exclusive Rights: Grants you exclusive control over your trademark for the registered goods/services within Zanzibar.
Legal Enforcement: Allows you to take legal action against infringers, imitators, and counterfeiters through Zanzibar’s legal system.
Market Positioning: Enhances brand recognition, consumer trust, and competitive differentiation in the Zanzibar market.
Asset Creation: Converts your brand into a tradable asset that can be licensed, franchised, assigned, or sold.
How the Zanzibar Trademark Registration Works
The Zanzibar trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
The process begins with a mandatory manual search at the Registry office in Zanzibar. If clear, the application is filed with all required documents. The application is physically filed and adheres to the single-class filing system, requiring a separate application for each class of goods or services
Examination
The Registrar examines for compliance. The mark must be distinctive and not descriptive, deceptive, or contrary to public order.
Acceptance & Publication
If the mark is accepted, it is published in the Zanzibar Government Gazette for public inspection.
Opposition Period
Any interested party may file opposition within the 60-day period. The Registrar hears and decides on the opposition, requiring parties to file evidence.
Registration
If the application is unopposed or successfully defended, the final registration fee is paid. The BPRA issues a physical Certificate of Registration.
Validity & Renewal
Registration is valid for ten years from the date of application and renewable indefinitely for periods of seven years each. It is recommended to renew at least three months before the expiry. If the deadline is missed, a 6-month grace period with a late fee applies.
