How the Vietnam Trademark Registration Works
The Vietnam trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
The Trademark applications are filed via the IP Vietnam online system or physically at IP Vietnam offices. An application number and filing date are issued upon submission.
Examination
The IP Vietnam conducts a formal examination and if deficiencies are found, a notice is issued and must be rectified within the prescribed deadline.
Acceptance & Publication
If the application passes formal examination, it is published in the Industrial Property Official Gazette within approximately 2 months from acceptance of form. IP Vietnam conducts substantive examination (normally 9–12 months from publication). Office Actions may be issued and must be responded to within the stipulated time limits.
Opposition Period
Third parties may file oppositions from the publication date until before the decision to grant registration. The opposition period runs for the entire substantive examination period (effectively 9-12 months), but oppositions are best filed early.
Registration
If the application satisfies all requirements the IP Vietnam issues a Notice of Intention to Grant and upon payment of the registration fee, the trademark is entered in the register and Trademark Registration Certificate is issued
Validity & Renewal
A Vietnamese trademark is valid for 10 years from the filing date. Renewable indefinitely for successive 10-year periods and renewal must be filed within 6 months before expiry. A 6-month grace period is available with late fees
