Timeline

Both the Benelux route (via BOIP) and the EUTM route (via EUIPO) achieve registration in approximately 4 to 6 months in straightforward cases without oppositions. The Benelux route is typically faster for targeted Benelux-only protection. Both timelines may extend significantly if opposition proceedings arise. The Benelux opposition period is 2 months from publication (extendable by 2 months); the EUTM opposition period is 3 months.

Validity & Renewal

Both Benelux trade marks and EUTMs are valid for 10 years from the filing date, renewable indefinitely for successive 10-year periods. The genuine use requirement applies to both: a Benelux trade mark must be put to genuine use in Belgium, the Netherlands, or Luxembourg within 5 years of registration; an EUTM must be put to genuine use in the EU (including Luxembourg) within 5 years. For the Benelux mark, use in any one of the three Benelux countries satisfies the use requirement for the entire Benelux registration. For the EUTM, the CJEU has established that genuine use must cover a territory that is more than token, though use in a significant part of the EU suffices.
