How the EUIPO Trademark Registration Works

The Europe trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

Applications are filed online through the EUIPO Portal with the applicant’s details, representation of the mark, and goods/services per the NICE Classification. A filing number is generated instantly.

Examination

EUIPO conducts a formal examination followed by a substantive examination for distinctiveness, clarity, and compliance with the EUTM Regulation. EUIPO does not automatically refuse applications due to earlier conflicting marks but alerts owners of earlier marks who may oppose the application.

Publication

If no objections are raised regarding formalities or distinctiveness, the mark is published in the EU Trade Marks Bulletin after acceptance.

Opposition Period

Third parties may file an opposition within 3 months from the date of publication. If no opposition is filed, or if resolved in the applicant’s favor, the mark moves to registration.

Registration

If unopposed, EUIPO issues the EUTM Registration Certificate, typically delivered electronically.

Validity & Renewal

EU Trade Marks are protected for 10 years from the filing date and may be renewed indefinitely in successive 10-year terms upon payment of renewal fees.
