Trademarks in Switzerland are administered by the Swiss Federal Institute of Intellectual Property (Institut Fédéral de la Propriété Intellectuelle – IPI). Switzerland is not an EU member but is part of the European single market via bilateral agreements. It is a member of the Madrid Protocol.

How the Switzerland Trademark Registration Works

The Sweitzerland  trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The application is filed with IPI (nationally) through the online system (e-trademark) or by post.

Examination

The IPI conducts a detailed examination for formalities, absolute grounds, and conflicts with prior registered Swiss marks. This is a rigorous process.

Acceptance & Publication

Once accepted, the mark is published in the Swiss Official Gazette of Commerce (SOGC) and on Swissreg.

Opposition Period

After registration and publication, third parties may file an opposition within 3 months from the publication date. Oppositions may be based on prior Swiss rights or well-known marks.

Registration

If no opposition is filed, or if any opposition is resolved in favour of the applicant, the trademark remains on the register. IPI does not issue a separate certificate registration is confirmed once published in Swissreg.

Validity & Renewal

A registered trademark in Switzerland is valid for 10 years from the filing date. It can be renewed indefinitely for successive ten- year periods by paying the renewal fee within the last 12 months before expiry or within a 6-month grace period with a surcharge.
