How the New Zealand Trademark Registration Works

The New Zealand trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

A free search of the IPONZ Trademarks Register using Trade Mark Check is strongly recommended to check for conflicting marks. The application is submitted via IPONZ secure online portal.

Examination

IPONZ examines the application for compliance with formal requirements and substantive grounds, compliance with the law including a cultural assessment for marks containing Māori elements).If your mark contains Māori elements, the application will be referred to the Māori Trade Marks Advisory Committee (MTAC). The MTAC will assess the proposed trade mark, and advise whether the use or registration of your mark is likely to offend Māori. An examination report is issued in due course.

Acceptance & Publication

If the application clears examination without objections, the mark is published in the Trademarks Journal for opposition.

Opposition Period

A 3-month opposition period follows publication. There is a requirement to wait 6 months from your filing date in case an application with an earlier priority date is received. If no complications arise, your accepted application will become registered 6 months after its filing date.

Registration

If there are no oppositions and all requirements are met, IPONZ issues a Registration Certificate, granting exclusive trademark rights.

Validity & Renewal

The protection is granted for a term of ten years. A request for renewal can be made up to 12 months in advance. The registration may be restored if the renewal fee is paid within the 6-month grace period following the due date.
