Trademark Registration in Libya - Protect Your Brand Nationwide

Libya’s Trade Mark Office has introduced a series of measures that have significantly affected trademark practice in the country. These include amendments to official fees, a substantial increase in renewal fees for the full term of protection, and the suspension of one‑year or multi‑year renewals in favour of mandatory renewals covering the full 10‑year term.

In addition, re‑filing of trademarks has been suspended until the final cancellation decision is issued and published in the Official Gazette. It is also reported that the Trade Mark Office has become affiliated with the Commercial Registry Authority.

How the Libya Trademark Registration Works

Filing

A trademark is filed in the Office with the Official fees.

Examination

Once a trademark application is filed, it is examined as to its registrability. If the mark lacks any requirement as provided for in the law and its implementing regulations, the application will be rejected by the examiner.

Appeal

The applicant may appeal the rejection of its application to a commission appointed for that purpose within 30 days as of the date of receiving the relevant official notification.

Acceptance and Publication

Trademark applications accepted are published in the Official Gazette. There is a 3-month period from the date of publication during which any interested party may file an opposition notice

Opposition and Registration

An opposition to the registration of a published trademark should be prosecuted before the Registrar by either a patent attorney or a lawyer. If not settled by the Registrar, or if either party objects to the decision issued by the Registrar, the opposition case is referred to the competent tribunal. In the absence of opposition, a published trademark is registered and the relative certificate will be issued.

Validity & Renewal

A trademark registration is valid for 10 years from the date of filing the trademark application, renewable for periods of 10 years. Further, trademarks should be renewed annually for a fee of US$2000.00 per year, as stated in Ministerial Resolution No. 586 of 2024 dated November 27, 2024.

The Name, address, nationality, and business of the applicant

An extract of the entry of the applicant company in the Commercial Register, or Certificate of Incorporation if the applicant is a company or a corporate body, legalised up to the Libyan Consulate in the applicant's home country.

A power of attorney signed and stamped by the applicant company and legalised up to the Libyan Consulate in the applicant's home country.

A certified copy of the priority document issued by any member country of the Paris Convention if the priority is to be claimed
