The specification of goods and services must be in Persian and must be clear and precise. Applicants should also note that class selection must account for Iran’s domestic industrial structure and the specific goods/services in which the brand will be used in the Iranian market.

Trademark Registration Procedure in Iran

Iran Trademark Search & Application

We begin with a comprehensive availability search of the IPGO register and the WIPO Madrid Database (for international registrations designating Iran) to identify potential conflicts before filing. Once clearance is confirmed and sanctions compliance has been verified, the application is prepared in Persian (Farsi, in Arabic script) and filed with IPGO in Tehran — either as a national filing or as the national phase of a Madrid Protocol designation. All documents must be in Persian or accompanied by certified Persian translations. Foreign applicants must be represented by a locally registered Iranian patent attorney (vakīl-e esmārī).

Formal & Substantive Examination

IPGO conducts a formal examination followed by a substantive examination on absolute grounds (distinctiveness, descriptiveness, deceptiveness, public order, Islamic values and morals, and official emblems) and relative grounds (conflicts with earlier registered marks and well-known marks in Iran). The examination on Islamic values and morals is a specific feature of Iranian trademark examination practice: marks that conflict with Islamic principles, contain prohibited symbols, or are deemed contrary to public morality under Islamic law will be refused. Office actions must be responded to within prescribed deadlines.

Acceptance and Publication

Once the application clears examination, the mark is published in the Official Gazette of Iran (Rooznameh Rasmi) and the IPGO Trademark Bulletin, opening a 30-day window for third-party opposition (extendable upon application).

Opposition Period

Third parties holding prior rights may file an opposition within 30 days from publication (extendable). Grounds include identity or similarity with an earlier registered or well-known mark, bad-faith filing, and other grounds under the 2008 Act. Oppositions are decided by IPGO, with appeal to the Administrative Court of Justice

Registration & Certificate

If no successful opposition is raised, IPGO registers the mark in the Iranian Trademark Register, issues a Certificate of Registration, and publishes the registration. The mark is then enforceable against third parties throughout Iran.

Validity & Renewal

The trademark is valid for 10 years from the filing date and is renewable indefinitely for successive 10-year periods on payment of renewal fees to IPGO.
