Why Trademark Registration in the Grenada Is Important ?
Exclusive Rights: Grants you exclusive legal ownership and control over your trademark for the registered goods/services throughout Grenada.
Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorized use through the Corporate Affairs and Intellectual Property Office (CAIPO) and Grenadian courts.
Nationwide Protection: Secures trademark protection across the entire territory of Grenada.
How the Grenada Trademark Registration Works
The Grenada trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
Trademark applications are filed with CAIPO through a local agent. The application must include the mark specimen, applicant information, and the list of goods and services with the relevant classes. A signed power of attorney appointing the local agent is mandatory.
Examination
CAIPO conducts a formal examination of the application and issues a filing receipt. The Office also examines the application on registrability requirements.
Publication
If accepted, the trademark application is published in the Gazette or official bulletin.
Opposition Period
Third parties may file an opposition within 1 month from the date of publication.
Registration
If no opposition is filed, or if the opposition is resolved in favour of the applicant, the trademark proceeds to registration and the Registrar issues the registration certificate.
Validity & Renewal
A Grenadian trademark is valid for 10 years from the date of registration and may be renewed indefinitely for successive 10-year terms. Renewal may be filed within 6 months before expiry, with a further 6-month grace period available after expiry subject to surcharge.
