DKPTO administers a first-to-file trademark system. It examines applications for formal compliance and absolute grounds, publishes allowed marks, and manages oppositions. After an application passes formal and substantive review, it is published in the Official Gazette (the Industrial Property Gazette of Denmark), allowing a 2-month opposition period.

How the Denmark Trademark Registration Works?

The Denmark trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The application is filed with the DKPTO. Denmark allows filing online, and DKPTO recommends e-filing for smoother processing. A valid application must at least contain three core things: the trademark itself, the list of goods/services, and the applicant details. The mark can be a word mark or another accepted mark type with an attached representation. The goods/services must be classified under the Nice Classification. DKPTO also notes that the list may initially be submitted in English, but a Danish version will be required. Foreign applicants are not required to appoint a representative.

Examination

DKPTO first checks whether the application meets the formal requirements, including the applicant’s details, postal address, clear representation of the mark, and properly classified goods/services. It then conducts substantive examination on absolute grounds and also searches for earlier similar marks valid in Denmark, such as Danish, EU, and international marks designating Denmark. If any formal defects are found, the applicant is usually given an opportunity to correct them.

Publication

If accepted, the trademark application is published in the Official Gazette.

Opposition Period

After publication, third parties have 2 months to oppose the application.

Registration

If the application is not opposed, or if any objections/deficiencies are resolved successfully, the trademark proceeds to registration and the certificate is issued.

Validity & Renewal

Trademarks are protected for 10 years from the date of registration and may be renewed indefinitely for successive 10-year terms upon payment of renewal fees.

Timeline

In straightforward cases, registration takes roughly 6–12 months. Formal examination is typically completed in about 6 weeks; after publication (about 3–4 months after filing), there is a 2 month opposition period. If no objections arise, final registration generally issues within 12–15 months of filing.
