Trademark registrations are governed by Decree-Law No. 203 on Trademarks and Other Distinctive Signs (1999). OCPI conducts both formal and substantive examination to assess compliance with legal requirements, distinctiveness, and conflicts with earlier rights. Cuba is a member of the World Intellectual Property Organization and a contracting party to the Madrid System for the International Registration of Marks.

How the Cuba Trademark Registration Works

The Cuba trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

Trademark applications are filed with OCPI either directly or through an authorized industrial property agent. Foreign applicants not domiciled in Cuba must file through a local agent. The application must include applicant details, representation of the mark, and specification of goods/services according to the Nice Classification.

Examination

OCPI conducts formal examination followed by substantive examination to assess distinctiveness, legality, and conflicts with prior trademarks. Absolute and relative grounds for refusal are examined.

Acceptance & Publication

If the application meets formal requirements, it is accepted and published in the Official Industrial Property Bulletin for public notice.

Opposition Period

Third parties may file an opposition within 60 days from the date of publication.

Registration

If no opposition is filed or if opposition proceedings are resolved in favor of the applicant, the trademark is granted and registration is completed upon payment of the prescribed fees.

Validity & Renewal

A trademark in Cuba is valid for 10 years from the application (filing) date and may be renewed indefinitely for successive 10-year periods. Renewal must be filed within the prescribed period, with a 6-month grace period available upon payment of additional fees.
