How the Brunei Trademark Registration Works?
Exclusive Rights: Grants you sole legal control over your trademark for the registered goods/services throughout Brunei.
Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorized use through Brunei’s legal system.
Nationwide Protection: Secures trademark protection across all of Brunei, regardless of where the business operates.
How the Brunei Trademark Registration Works?
Filing
The application is filed with BruIPO, containing the mark, applicant details, a specification of goods/services (Nice Classification), and the required forms. A separate application is needed for each class.
Examination
The BruIPO examines the application for formal compliance and substantive grounds. An examination report is issued if objections are raised.
Acceptance & Publication
If accepted, the mark is published in the Brunei Government Gazette and on BruIPO's website.
Opposition Period
A statutory two-month opposition period commences from the publication date for third parties to file an opposition.
Registration
If no opposition is filed or successfully defended, the applicant pays the registration fee. BruIPO then issues the Certificate of Registration.
Validity & Renewal
A trademark registration in Brunei is valid for 10 years from the filing date. It can be renewed indefinitely for subsequent 10-year periods. Renewal applications must be filed within six months before the expiry date
