How the Brazil Trademark Registration Works
Filing
Trademark applications are filed electronically with INPI through a Brazilian trademark attorney. The application includes applicant particulars, representation of the mark, and specification of goods/services under the Nice Classification. An application number is issued upon filing.
Examination
INPI conducts formal and substantive examination to assess registrability, including distinctiveness and conflicts with earlier trademarks.
Publication
If accepted, the trademark application is published in the Official Gazette (Revista da Propriedade Industrial).
Opposition Period
Third parties may file an opposition within 2 months from the date of publication.
Registration
If no opposition is filed, or if opposition proceedings are resolved in favor of the applicant, the trademark proceeds to registration and a certificate is issued.
Validity & Renewal
10 years from the filing date and may be renewed indefinitely for successive 10-year periods upon payment of renewal fees.
