How the Belgium Trademark Registration Works
The Belgium trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
Trademark applications are filed online with BOIP. The application must include applicant details, representation of the mark, and specification of goods/services under the Nice Classification. Multi-class applications are permitted.
Examination
BOIP conducts formal examination and substantive examination limited to absolute grounds (e.g., descriptiveness, lack of distinctiveness, public policy). Relative grounds are not examined ex officio.
Acceptance & Publication
If the application meets requirements, it is accepted and published in the Benelux Trademarks Register / Bulletin.
Opposition Period
Third parties may file an opposition within 2 months from the date of publication.
Registration
If no opposition is filed, the trademark proceeds to registration shortly after the opposition period. If opposition is filed, registration depends on the outcome of proceeding.
Validity & Renewal
A Benelux trademark (covering Belgium) is valid for 10 years from the filing date and may be renewed indefinitely for successive 10-year periods. A 6-month grace period is available after expiry upon payment of surcharge.
