Trademark Registration Procedure in Belarus

Here is the step-by-step process followed for trademark registration in Belarus

The application is submitted to the NCIP online or in paper form. Upon filing, the applicant receives a filing receipt with an application number and filing date. Applications may be filed as multi-class or single-class applications.

Applications undergo both formal examination and substantive examination. The Registrar may refuse an application if the mark is not distinctive, conflicts with existing rights, or falls within prohibited categories.

Publication

Within two months from the NCIP's decision to accept the application, the trademark is published on the official NCIP website.

Registration Certificate

If the application successfully passes all stages of examination, the trademark is registered in the State Register of Trademarks, and the applicant is issued a certificate of registration (subject to payment of the patent fee). The official fees for registration and publication must be paid within three months from the date of forwarding of the decision on registration.

Timeline

Timelines can vary depending on the complexity of the application, any objections raised, and administrative delays at the NCIP approximately 12-18 months. An accelerated examination procedure is available for applicants requiring faster registration.

Validity & Renewal

Initial registration period: 10 years from the filing date (application date). Renewal: Indefinitely renewable for successive 10-year periods. A request for renewal must be filed within the prescribed period, with a six-month grace period available subject to surcharge. Trademark rights become enforceable upon registration; however, the term of protection is calculated from the filing date.
