The application is submitted with CAIPO, accompanied by the prescribed filing fee. Upon filing, the applicant receives a filing receipt with an application number and filing date.

Applications undergo both formal examination and substantive examination. The Registrar may refuse an application if the mark is not distinctive, conflicts with existing rights, or falls within prohibited categories. Signs not deemed distinctive can be registered if distinctiveness has been acquired through use.

Publication

If the application meets all formal and substantive requirements, the trademark is published in the Trademarks Journal. Publication is for opposition purposes, and the applicant is notified of the publication date.

Opposition

Barbados has a formal opposition procedure. The opposition period is 90 days depending on the source, and interested third parties may file an opposition within this window. The opposition period begins from the date of publication in the Trademarks Journal.
