How the Australia Trademark Registration Works

The Australia trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

File your trade mark application online via IP Australia’s Online Services. Optional services like TM Headstart allow early examiner feedback before formal filing.

Examination

IP Australia conducts examination to check compliance with law and prior rights. If issues arise, an examination report will be issued requiring a response.

Acceptance & Publication

If the application passes examination, IP Australia accepts it and advertises it in the Australian Official Journal of Trade Marks for a two-month opposition period.

Opposition Period

Any Third parties have two months from publication to oppose the application. If an opposition is filed, proceedings must be dealt with before registration.

Registration

If the application is unopposed or successfully defended, the final registration fee is paid. The BPRA issues a physical Certificate of Registration.

Validity & Renewal

A trademark registration in Australia is valid for 10 years from filing date and can be renewed indefinitely for further 10 year terms upon payment of renewal fees
