Trademark Registration in ARIPO - Protect Your Brand Nationwide

The African Regional Intellectual Property Organization (ARIPO) provides a regional framework for the protection of intellectual property rights among its member states. Trademark protection is available through the Banjul Protocol on Marks, which enables applicants to file a single trademark application designating one or more participating member countries. ARIPO conducts a formal examination of the application and publishes accepted marks in its official journal. Each designated member state retains the right to examine the application under its national laws and may issue a refusal within the prescribed period. If no refusal is raised, the trademark enjoys protection in the designated countries.

Countries Covered in ARIPO

Under the Banjul Protocol, trademark protection may be obtained in the following ARIPO member states:

Botswana, Cape Verde, Eswatini, Lesotho, Liberia, Malawi, Mozambique, Namibia, São Tomé & Príncipe, Tanzania, Uganda, Zambia, and Zimbabwe.

How the ARIPO Trademark Registration Works

The ARIPO trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

A single trademark application is filed with ARIPO designating one or more member states. The application includes applicant details, representation of the mark, and specification of goods/services under the Nice Classification.

Formal Examination

ARIPO conducts a formal examination to ensure compliance with filing requirements.

Publication

If the application meets the formal requirements, it is published in the ARIPO Marks Journal.

Examination by Member States

Each designated member state reviews the application under its national trademark law and may issue a refusal if necessary.

Registration

If no refusal is issued within the prescribed period, the trademark proceeds to registration and protection becomes effective in the designated states.

Validity & Renewal

Trademarks registered through ARIPO are generally valid for 10 years from the filing date and may be renewed for successive 10-year periods, subject to the laws of the designated member states.
