Trademark administration in India is handled by the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM) under the Ministry of Commerce & Industry. The Registry has offices across Mumbai, Delhi, Chennai, Kolkata, and Ahmedabad which administers the entire lifecycle of a trademark from application and examination to publication, opposition, and registration. India follows a detailed process of formal and substantive examination to ensure marks are distinctive and do not conflict with existing rights. The Registry functions on a first-to-use basis, giving precedence to earlier use over later filings.

How the India Trademark Registration Works

The India trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The application is submitted through the IP India portal with the required details, including the trademark representation, applicant information, and the list of goods/services as per the NICE Classification. Once filed, the application number is issued immediately.

Examination

The Registry conducts a formal examination to verify documents and filing accuracy, followed by a substantive examination to assess distinctiveness and compliance with Trademark Act 1999, including a search for conflicting prior trademarks and an examination report is issued. The applicant has 1 month to file a written response and/or attend a hearing to address the examiner's objections. Applicants opting for Expediated process of an Application for Registration will receive accelerated office actions, including fast examinations and faster scheduling of subsequent hearings.

Acceptance & Publication

If the application clears examination without objections (or after overcoming objections), the mark is formally accepted and the mark is published in the online Trademarks Journal for 4 months, open for public opposition.

Opposition Period

Once published, third parties have a statutory 4-month period to file an opposition. If no opposition is filed, or if any opposition is successfully resolved in favour of the applicant, the application proceeds to the registration stage.

Registration

Upon successful completion of the opposition period, the Registry issues the official Trademark Registration Certificate digitally. No additional fee is payable at this stage, the government fee is paid in full at the time of filing. Protection is granted from the original filing date.

Validity & Renewal

The protection is granted for a term of ten years, with the option to renew indefinitely in successive ten-year periods by paying the prescribed renewal fees even within 6 months after the expiry date (with a late fee).
