India’s 2026 Trademark Opposition Disposal Drive

India Opens a Special Disposal Drive for Pending Trademark Oppositions: What Brand Owners Must File Before December 2026

India’s Trade Marks Registry has opened a dedicated Special Disposal Drive to clear long-pending trademark opposition matters that are ripe for settlement or withdrawal. Under Public Notice Ref. No. TMR/Public Notice/2026/4546, dated August 31, 2026, the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) will hold hybrid hearings every working Friday from September through December 2026, giving applicants, opponents, and their advocates a clear, time-bound window to resolve outstanding India trademark opposition proceedings without a full contested hearing.

CGPDTM Public Notice – Special Disposal Drive

Why the Trade Marks Registry Is Running This Drive

The Registry has framed the initiative as a backlog-clearance measure aimed at reducing the volume of pending oppositions that are effectively resolved between the parties but remain administratively open. By creating a structured, recurring hearing slot dedicated solely to settlement and withdrawal matters, the Office aims to improve transparency and turnaround time in the opposition pipeline, while upholding the principles of natural justice for parties who still require a hearing on the merits.

Hearing Schedule: Year-Wise Breakdown

Hearings are allocated by the filing year of the underlying trademark application, grouped into 10-year blocks, with each month of the drive dedicated to a specific filing-year range:

Hearing Schedule Application Filing Year Range Hearing Time (Hybrid)
All Fridays of September 2026 Applications filed prior to 2000 10:30 AM–1:30 PM & 2:30 PM–4:30 PM
All Fridays of October 2026 Applications filed between 2001–2010 10:30 AM–1:30 PM & 2:30 PM–4:30 PM
All Fridays of November 2026 Applications filed between 2011–2020 10:30 AM–1:30 PM & 2:30 PM–4:30 PM
All Fridays of December 2026 Applications filed between 2021–till date 10:30 AM–1:30 PM & 2:30 PM–4:30 PM

Who Should Take Action

The drive applies to any pending India trademark opposition where the parties have reached an amicable settlement, or where either party wishes to withdraw the application or the opposition. Trademark applicants, opponents, and their authorized advocates or agents with matters falling into any of the four filing-year blocks above should identify affected cases and prepare to act ahead of the relevant month.

Filing Requirements Before the Scheduled Hearing

  • Settlement deeds or withdrawal requests must be submitted at least 3 days before the scheduled Friday hearing date.
  • Submissions can be made via the online IP India portal or by email to the Registry.
  • Parties and advocates should proactively check the status of their opposition matters rather than waiting for individual notice.
  • Hearings are hybrid: parties may appear physically at the Trade Marks Registry or virtually via the official link published on the IP India portal.

Consequences of Non-Appearance

The Public Notice states that non-appearance or non-compliance on the scheduled hearing date will result in the matter being decided ex-parte or on the merits based on the records available with the Office, applied in accordance with the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. Parties who do not act within the applicable window risk losing the opportunity to formalize a settlement on their own terms.

What This Means for Brand Owners

For trademark owners and opponents with older India filings, this drive is a practical opportunity to close out matters that have already been settled commercially but remain open on the Registry’s docket. Aligning the settlement deed, withdrawal letter, or consent terms with the correct filing-year window — and filing at least three days ahead of the relevant Friday — can allow a case to be disposed of without a contested hearing before year-end.

Brand owners with opposition portfolios spanning multiple filing years should map each pending matter to its corresponding month in the schedule now, rather than waiting until the relevant block is underway.

Frequently asked questions

What is the Special Disposal Drive for trademark oppositions in India?

It is a time-bound listing exercise by the Trade Marks Registry that reserves Friday hearing slots from September to December 2026 for pending oppositions that are being settled or withdrawn, so they can be disposed of without a full contested hearing.

How do I know which month my opposition will be heard in?

Check the filing year of the underlying trademark application. Applications filed before 2000 are heard in September, 2001 to 2010 in October, 2011 to 2020 in November, and 2021 onwards in December 2026.

What is the deadline to file a settlement deed or withdrawal request?

At least 3 days before the scheduled Friday hearing. Because the notice does not specify clear days versus working days, filing five to seven days ahead is the safer practice.

Can I attend the hearing online?

Yes. Hearings are hybrid, so you may appear in person at the Trade Marks Registry or join virtually through the official link published on the IP India portal.

Will the Registry send me a separate hearing notice?

You should not rely on it. The Public Notice asks parties, advocates and agents to proactively check the status of their opposition matters rather than wait for individual intimation.

Does the drive apply to oppositions that are still contested?

No. It is limited to matters where the parties have settled or where the application or opposition is being withdrawn. Contested matters continue on the normal hearing track.
