Trademarks in Venezuela are administered by the Autonomous Intellectual Property Service (Servicio Autónomo de la Propiedad Intelectual – SAPI), the official government authority responsible for industrial property matters. SAPI operates as an autonomous body attached to the Venezuelan government and oversees the registration and administration of trademarks, patents, industrial designs, and other intellectual property rights in accordance with national legislation and international treaties to which Venezuela is a party.

How the Trademark Registration Works?

The   Venezuela trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

Trademark applications are filed with SAPI either electronically or physically. Once filed, SAPI issues an official filing date and application number.

Examination

SAPI conducts a preliminary review to verify compliance with formal requirements and also a substantive examination. If objections arise, SAPI issues an Examination Report, which must be responded to within the prescribed time limit.

Acceptance & Publication

If the application complies with legal requirements, it is accepted and published in the Official Industrial Property Gazette. After publication, third parties generally have 30 days to file oppositions against the mark.

Opposition Period

Following publication, third parties have 30 days from the publication date to file an opposition.

Registration

If there are no oppositions, or if oppositions are resolved in favor of the applicant, SAPI issues a decision to register the trademark. The applicant then pays the registration fees, and SAPI issues a Trademark Registration Certificate.

Validity & Renewal

A registered trademark in Venezuela is valid for 15 years from the registration date. Registered marks may be renewed indefinitely in successive 15-year periods. Venezuela has re-established a 6- month grace period for filing renewals after expiry (with surcharge).

Product/ services to be covered (International class).

Original Power of Attorney duly notarized and apostilled, or legalized before the Venezuelan Consulate, for submission before the Patent and Trademark Office.

For corporate applicants: Certificate of Incorporation may be required

Identification documents may be requested for foreign applicants (Passport)

Certified priority document (if claiming priority).

Spanish Translations: All documents submitted before public authorities must be translated into Spanish by a certified Venezuelan translator in compliance with local regulations. (Translation Costs: Approximately USD 0.10 per word in Spanish, subject to document length.)
