Trademark Registration in Venezuela: How to File and Protect Your Brand
Venezuela operates a first-to-file trademark system, meaning brand rights are generally awarded to the first party to file a valid application rather than the first to use a mark in commerce. For domestic and international businesses entering the Venezuelan market, securing a registered trademark with the national intellectual property office is the most reliable way to establish exclusive rights, deter infringement, and build lasting brand value. This guide explains how to register a trademark in Venezuela — from classification and filing through examination, publication, opposition, and renewal.
Why Trademark Registration in Venezuela Is Important for Brand Protection?
Exclusive Rights: Grants you exclusive legal ownership and control over your trademark for the registered goods/services throughout Venezuela.
Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorized use through the Autonomous Service of Intellectual Property (SAPI) and Venezuelan courts.
Nationwide Protection: Secures trademark protection across all regions of Venezuela, regardless of where the business operates.
Trademark Registration Procedure in Venezuela
Here is the step-by-step process followed for trademark registration in Venezuela.
Filing
Trademark applications are filed with SAPI either electronically or physically. Once filed, SAPI issues an official filing date and application number.
Examination
SAPI conducts a preliminary review to verify compliance with formal requirements and also a substantive examination. If objections arise, SAPI issues an Examination Report, which must be responded to within the prescribed time limit.
Acceptance & Publication
If the application complies with legal requirements, it is accepted and published in the Official Industrial Property Gazette. After publication, third parties generally have 30 days to file oppositions against the mark.
Opposition Period
Following publication, third parties have 30 days from the publication date to file an opposition.
Registration
If there are no oppositions, or if oppositions are resolved in favor of the applicant, SAPI issues a decision to register the trademark. The applicant then pays the registration fees, and SAPI issues a Trademark Registration Certificate.
Validity & Renewal
A registered trademark in Venezuela is valid for 15 years from the registration date. Registered marks may be renewed indefinitely in successive 15-year periods. Venezuela has re-established a 6- month grace period for filing renewals after expiry (with surcharge).
Governing Law
Trademark protection in Venezuela is administered by the Autonomous Service of Intellectual Property (Servicio Autónomo de la Propiedad Intelectual, or SAPI) through its Industrial Property Registry. Following Venezuela’s withdrawal from the Andean Community, the country reverted to applying its domestic Industrial Property Law, which now serves as the principal statute governing the registration, protection, and enforcement of trademarks, trade names, and other distinctive signs.
Because the framework has evolved alongside Venezuela’s changing position within regional IP arrangements, certain procedural details including registration terms and classification practice — are applied according to prevailing SAPI practice. Applicants are advised to confirm current requirements with the Registry or local counsel before filing.
