Trademark Registration in Philippines - Protect Your Brand Nationwide

Trademark protection in the Philippines is governed by the Intellectual Property Code of the Philippines (Republic Act No. 8293), as amended, and administered by the Intellectual Property Office of the Philippines (IPOPHL). IPOPHL conducts both absolute and relative examination, including examination against earlier filed or registered trademarks. The process is known for its strict compliance requirements and defined, non-extendible timelines.

Why Trademark Registration in the Philippines Is Important for Brand Protection?

Exclusive Rights: Grants you exclusive legal ownership and control over your trademark for the registered goods/services throughout the Philippines.

Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorized use through the Intellectual Property Office of the Philippines (IPOPHL) and Philippine courts.

Nationwide Protection: Secures trademark protection across all regions of the Philippines.

Market Positioning: Strengthens brand identity, builds consumer trust, and enhances competitive advantage in the Philippine market.

How the Philippines Trademark Registration Works

The Philippines trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

1

Filing

Trademark applications are filed with IPOPHL Electronically through the IPOPHL eTMFile system or manually at IPOPHL offices. An application number and filing date are issued upon submission.

2

Examination

A formal and substantive examination is conducted and if deficiencies are found, the applicant must correct them within the prescribed deadline.

3

Acceptance & Publication

Once accepted, the mark is published in the IPOPHL e-Gazette and in a newspaper of general circulation. A 30-day opposition period commences from the date of newspaper publication.

4

Opposition Period

Once published, third parties have 30 days to file an opposition.

5

Registration

If no opposition is filed, or if opposition proceedings are resolved in favour of the applicant, IPOPHL issues a Notice of Allowance and upon payment of the registration fee, the trademark is entered in the register and a Certificate of Registration is issued.

6

Validity & Renewal

A Philippine trademark is valid for 10 years from the filing date. Renewable indefinitely for successive 10-year periods. Renewal must be filed within 6 months before expiry. A 6-month grace period is available with surcharge.
