Trademark Registration in Mongolia - Protect Your Brand Nationwide

Trademark registration in Mongolia is administered by the Intellectual Property Office of Mongolia (IPO Mongolia — Mongol Ulsyn Oyu Uhaaны Gazaryn Tamga), the central government authority responsible for the filing, examination, publication, and registration of trademarks in Mongolia. IPO Mongolia operates under the Government of Mongolia and administers the trademark system under the Law on Trademarks and Geographical Indications. Mongolia follows a first-to-file principle and includes both formal and substantive examination prior to registration. Mongolia is a member of the Paris Convention, the Madrid Protocol, the Nice Agreement, the TRIPS Agreement, and is a WTO member. Mongolia has also entered into bilateral IP cooperation agreements with China, Russia, and other neighbouring and trading-partner states, reflecting its strategic position as a landlocked country bordered exclusively by China and Russia.

Introduction

Mongolia is a vast, landlocked country in East and Central Asia, sandwiched between the Russian Federation to the north and the People’s Republic of China to the south, east, and west. Ulaanbaatar, the capital, is home to approximately half the country’s population and is the centre of Mongolia’s commercial, financial, and political activity. Mongolia has the world’s lowest population density for a sovereign state and one of the world’s most extreme continental climates. The Mongolian economy is dominated by mining — Mongolia has some of the world’s largest untapped reserves of coal, copper, gold, uranium, and rare earth elements — alongside herding and animal husbandry (the traditional nomadic pastoral economy remains significant), cashmere production (Mongolia is the world’s second-largest producer of cashmere, after China), and a growing services and construction sector. Mongolia transitioned from a Soviet-style planned economy to a market economy following the democratic revolution of 1990, and its legal and IP framework has been progressively modernised since independence, drawing on both civil law influences from its Soviet period and international IP standards through WTO and treaty membership. Mongolia’s geographic position — bordered solely by China and Russia — and its role as a corridor for China-Russia trade and the broader Northern Economic Corridor make it strategically significant for businesses with interests in Northeast Asia. Trademark protection is relevant for businesses in mining, cashmere and textiles, food and beverage, tourism, financial services, and any sector operating in the Mongolian market or using Mongolia as a transit corridor.

Why Trademark Registration in Mongolia Is Important for Brand Protection?

Exclusive Rights: Grants exclusive legal ownership and the right to use your trademark throughout Mongolia for the registered goods and services, with statutory priority over later conflicting marks under the first-to-file system.

Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorised use through IPO Mongolia and the Mongolian courts, with civil, administrative, and criminal remedies available under the Law on Trademarks.

Nationwide Protection: Secures trademark protection across the entire Mongolian territory, including Ulaanbaatar and all 21 aimags (provinces), and supports anti-counterfeiting actions through border measures administered by the General Customs Agency of Mongolia.

Mining & Resources Investment: Mongolia’s growing mining sector — anchored on the Oyu Tolgoi copper-gold mine (one of the world’s largest), the Tavan Tolgoi coal deposit, and significant uranium and rare earth reserves — attracts substantial international investment where brand and contractor identity protection is commercially significant.

Madrid Protocol & Northeast Asian Gateway: Mongolia’s Madrid Protocol membership enables cost-effective multi-country filing strategies that include Mongolia alongside China, Russia, and other Northeast Asian jurisdictions in a single WIPO international registration.

Asset Value: A registered trademark is a transferable intangible asset that can be licensed, franchised, pledged, or assigned to support commercial growth, joint ventures, export financing, and corporate transactions in the Mongolian and regional market.

Trademark Registration Procedure in Mongolia

Here is the step-by-step process followed for trademark registration in Mongolia. Legacy Partners manages each stage on your behalf — from initial clearance through to issuance of the registration certificate by IPO Mongolia.

1

Mongolia Trademark Search & Application

We begin with a comprehensive availability search of the IPO Mongolia register and the WIPO Madrid Database (for international registrations designating Mongolia) to identify potential conflicts before filing. Once clearance is confirmed, the application is prepared in Mongolian (Cyrillic script) and filed with IPO Mongolia in Ulaanbaatar — either as a national filing or as the national phase of a Madrid Protocol designation. Legacy Partners manages all documentation, translation, transliteration into Cyrillic script, and power of attorney requirements on the client’s behalf through its network of experienced local patent attorneys in Ulaanbaatar.

2

Formal & Substantive Examination

IPO Mongolia conducts a formal examination (verifying applicant details, classification, fees, power of attorney, and documentation completeness) followed by a substantive examination on both absolute grounds (distinctiveness, descriptiveness, deceptiveness, public order, and prohibited symbols including national emblems) and relative grounds (conflicts with earlier registered marks and well-known marks in Mongolia). Office actions must be responded to within prescribed deadlines. Foreign applicants must be represented by a locally registered patent attorney (patent tusgailan temtsegch).

3

Acceptance and Publication

Once the application clears examination, the mark is published in the Official Gazette of IPO Mongolia, opening a three-month window for third-party opposition.

4

Opposition Period

Third parties holding prior rights may file an opposition within three (3) months from the date of publication. Grounds include identity or similarity with an earlier registered or well-known mark, bad-faith filing, or other grounds under the Law on Trademarks. Oppositions are decided by IPO Mongolia, with appeal available to the Administrative Court and the Supreme Court of Mongolia.

5

Registration & Certificate

If no successful opposition is raised, IPO Mongolia registers the mark in the State Register of Trademarks of Mongolia, issues a Certificate of Registration, and publishes the registration. The mark is then enforceable against third parties throughout Mongolia.

6

Validity & Renewal

The trademark is valid for 10 years from the filing date and is renewable indefinitely for successive 10-year periods on payment of renewal fees to IPO Mongolia.

Governing Law

Trademark protection in Mongolia is principally governed by the Law on Trademarks and Geographical Indications of Mongolia (as amended), which establishes the legal framework for trademark registration, examination, opposition, licensing, assignment, and enforcement. The Law reflects Mongolia’s civil law tradition (rooted in Soviet-era legal structures, progressively modernised since 1990) and its TRIPS obligations as a WTO member. The Law is supplemented by the Civil Code of Mongolia for contractual IP matters, the Criminal Code for criminal enforcement of trademark rights, and Customs legislation for border measures. Mongolia is a member of the Paris Convention, the Madrid Protocol, the Nice Agreement, and the TRIPS Agreement. IPO Mongolia conducts both absolute and relative grounds examination — a point of distinction from many other trademark offices that examine only absolute grounds. Foreign applicants are required to use a registered Mongolian patent attorney for all proceedings before IPO Mongolia.

Trademark Classes Mongolia (Nice Classification)

Mongolia follows the Nice Classification system, categorising trademarks into 45 classes — 34 for goods (Classes 1–34) and 11 for services (Classes 35–45). Multi-class applications are permitted. The specification of goods and services must be filed in Mongolian (Cyrillic script) and must be clear and precise. Expert guidance on class selection is particularly important for Mongolia’s key commercial sectors: mining and mineral processing (Classes 4, 37, 40), cashmere and wool textiles (Classes 23, 24, 25), food and beverage (Classes 29, 30, 32, 33), construction and engineering services (Classes 37, 42), financial services (Class 36), tourism (Classes 39, 43), and telecommunications (Class 38).

Timeline

Approximately 12 to 18 months for registration in a straightforward case without objections or oppositions. IPO Mongolia’s examination process covers both absolute and relative grounds, which contributes to the processing timeline. Where a Madrid Protocol designation is used, the timeline may vary depending on the procedural status at WIPO and examination requirements at IPO Mongolia. Applicants are advised to file early, particularly given the relative grounds examination which may uncover prior conflicts not immediately apparent from a preliminary search.

Validity & Renewal

The trademark is protected for 10 years from the filing date, renewable indefinitely for further 10-year periods on payment of renewal fees to IPO Mongolia. A grace period may be available after expiry, subject to applicable surcharges. Mongolia requires genuine use of the trademark within three (3) years of registration — a notably shorter non-use vulnerability period than many jurisdictions. Failure to use the mark within this period may expose it to cancellation on grounds of non-use upon application by any interested third party. Rights holders should plan for genuine commercial use in Mongolia at or soon after registration and maintain careful documentation of use activities.
