Why Trademark Registration is Important in Australia?

Exclusive Rights: Grants you exclusive legal ownership and control over your trademark for the registered goods/services throughout Australia.

Legal Enforcement: Empowers you to take action against infringement, counterfeiting, and unauthorized use through IP Australia and Australian courts.

Nationwide Protection: Secures trademark protection across all states and territories of Australia.

How the Australia Trademark Registration Works

The Australia trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

1

Filing

File your trade mark application online via IP Australia’s Online Services. Optional services like TM Headstart allow early examiner feedback before formal filing.

2

Examination

IP Australia conducts examination to check compliance with law and prior rights. If issues arise, an examination report will be issued requiring a response.

3

Acceptance & Publication

If the application passes examination, IP Australia accepts it and advertises it in the Australian Official Journal of Trade Marks for a two-month opposition period.

4

Opposition Period

Any Third parties have two months from publication to oppose the application. If an opposition is filed, proceedings must be dealt with before registration.

5

Registration

If the application is unopposed or successfully defended, the final registration fee is paid. The BPRA issues a physical Certificate of Registration.

6

Validity & Renewal

A trademark registration in Australia is valid for 10 years from filing date and can be renewed indefinitely for further 10 year terms upon payment of renewal fees
