Filing a trademark in the United States costs US$350 per class in official USPTO fees, as long as you choose your goods and services from the USPTO’s ID Manual and give complete information. Surcharges of US$100–200 per class apply otherwise, and later fees for proving use, maintenance and renewal follow the filing fee.

Key findings
- Base filing fee: US$350 per class. The old TEAS Plus and TEAS Standard options were replaced by one base application in January 2025.
- Surcharges can more than double the cost: +US$100 per class for missing information, +US$200 per class for writing your own description instead of using the ID Manual, and +US$200 per class for every extra 1,000 characters.
- Intent-to-use filings cost more: a Statement of Use adds US$150 per class, and each 6-month extension adds US$125 per class.
- First 10 years, one class: about US$1,575 in official fees for a correctly filed, use-based application, including the Section 8 & 15 and Section 8 & 9 maintenance filings.
- Madrid route: designating the US through WIPO costs US$600 per class (paid to WIPO), on top of WIPO’s own fees.
- Foreign applicants must be represented by a US-licensed attorney, so professional fees always apply on top of these official fees.

Direct US filing or the Madrid Protocol?
- Direct filing: US$350 per class to the USPTO, filed by a US-licensed attorney. Best when the US is your main market or you need a precise description of goods.
- Madrid designation: US$600 per class (the US individual fee, paid through WIPO), plus WIPO’s basic fee. It can be cheaper when you are protecting several countries at once, but the registration depends on your home application for five years, and US objections still need a US attorney to answer.
- Exporting from the US: certifying an international application based on one US filing costs US$100 per class (US$150 if based on more than one).
How to keep your USPTO fees low
- Use the ID Manual. Picking pre-approved descriptions avoids the US$200 free-form surcharge in every class.
- File complete information. Applicant details, entity type, the mark, specimens (for use-based filings) and correct fees avoid the US$100 insufficient-information surcharge.
- Keep descriptions short. Each extra 1,000 characters of custom text costs another US$200 per class.
- Choose the right filing basis. If you already sell in the US, a use-based filing avoids the Statement of Use and extension fees.
- Diarise maintenance deadlines. Filing in the grace period adds US$100 per class to each filing.
How to read these figures
- Official fees only. Figures exclude attorney fees, searches and specimen preparation. Foreign-domiciled applicants must be represented by a US-licensed attorney.
- Per class. Most fees are charged per class of goods or services. A few, marked *, are charged per application.
- Electronic filing. All figures are for electronic filing; paper filings are only accepted in rare cases and cost more.
- Currency. USPTO fees are set in US dollars. EUR figures are approximate, based on the ECB reference rate of 26 October 2026 (EUR 1 = US$1.1188), and will move with the exchange rate.
- Updates. The USPTO revises its fee schedule from time to time. Always confirm current fees before filing.
USA trademark fees: FAQ
How much does it cost to register a trademark in the USA in 2026?
The USPTO’s base filing fee is US$350 per class. Surcharges of US$100–200 per class apply if information is missing or you write your own description of goods and services. Intent-to-use applications add US$150 per class for the Statement of Use.
Are TEAS Plus and TEAS Standard still available?
No. Since 19 January 2025 the USPTO uses a single base application at US$350 per class, with surcharges replacing the old TEAS Plus and TEAS Standard fee levels.
Is the USPTO fee charged per class?
Yes. The base fee and most surcharges are charged for each class of goods or services in the application.
What are the USPTO trademark surcharges?
US$100 per class for insufficient information, US$200 per class for using free-form text instead of the ID Manual, and US$200 per class for each additional 1,000 characters of free-form text.
How much does it cost to keep a US trademark registered?
US$575 per class for the combined Section 8 and 15 declarations between years 5 and 6, and US$650 per class for the combined Section 8 and 9 renewal every 10 years. Filing in the grace period adds US$100 per class to each filing.
Do foreign companies need a US attorney to file?
Yes. Applicants whose domicile is outside the United States must be represented by an attorney licensed in a US state, so professional fees apply on top of the official fees.
Is it cheaper to designate the USA through the Madrid Protocol?

A notice of opposition costs US$600 per class. The first 30-day extension of time to oppose is free; later extensions cost US$200 or US$400.
