Trademark law and IP office in Latvia
Trademarks in Latvia are governed by the Trade Mark Law, with procedures under the Law on Industrial Property Institutions and Procedures. The Patent Office of the Republic of Latvia examines and registers marks and publishes registrations in its official publication. Oppositions, invalidation and revocation requests and appeals go to the Industrial Property Board of Appeal, whose decisions can be taken to court. Latvia has been a member of the Paris Convention since 7 September 1993, the Nice Agreement since 1 January 1995 and the Madrid Protocol since 5 January 2000.
Use requirements and non-use
Under Section 26 of the Trade Mark Law, if the owner has not started genuine use of the mark within five years of the day the registration procedure is completed, or use has been suspended for five consecutive years, sanctions and restrictions apply unless there was due cause. These include revocation of the registration and limits on relying on the mark against others. Keep dated invoices, packaging, advertising and distributor agreements that show the mark in use in Latvia.
Opposition, objections and appeals
Examination
The Patent Office checks formal requirements and absolute grounds for refusal only. It does not compare your mark with earlier rights; owners of earlier rights can contest the mark after registration.
Opposition
Interested persons can file a notice of opposition within three months of the official publication of the registration. The Industrial Property Board of Appeal examines it; a successful opposition invalidates the registration, fully or in part. The official fee is €200.
Appeals
Decisions of the Patent Office can be appealed to the Industrial Property Board of Appeal, for an official fee of €170.
