Trademark law and IP office in Poland
Trademarks in Poland are governed by the Industrial Property Law of 30 June 2000. The Patent Office of the Republic of Poland (Urząd Patentowy RP) in Warsaw examines applications on absolute grounds, publishes them in the Patent Office Bulletin (BUP), decides oppositions, and announces grants in the Patent Office News (WUP). Poland has been a member of the Paris Convention since 10 November 1919 and of the Madrid Protocol and the Nice Agreement since 4 March 1997.
Use requirements and non-use
Under Article 169 of the Industrial Property Law, the right of protection lapses if the mark is not put to genuine use for the registered goods for five successive years after the grant decision, unless there are serious reasons for non-use. Keep dated invoices, packaging, advertising and distributor agreements that show the mark in use in Poland.
Opposition, objections and appeals
Examination
The Patent Office examines the absolute grounds for refusal. It does not refuse on earlier rights by itself; their owners can oppose.
Opposition
Within three months of publication in the Patent Office Bulletin, the holder of an earlier trade mark or other earlier right can file an opposition. The official fee is PLN 600.
Reconsideration and contentious proceedings
Decisions can be challenged by a request for reconsideration (PLN 1,000 after an opposition decision). A request to start contentious proceedings, such as invalidation or lapse of a right, costs PLN 1,000.
