Trademark protection in Germany is governed by the German Trade Mark Act (Markengesetz) and administered by the German Patent and Trade Mark Office (DPMA).  Germany is a member of the European Union, and applicants may alternatively obtain protection via an EU Trade Mark (EUTM) filed with the EU Intellectual Property Office (EUIPO), which grants protection across all EU member states.

How the Germany Trademark Registration Works

The Germany trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The Trademark applications are filed with the German Patent and Trade Mark Office (DPMA) electronically via DPMA online filing systems, or in paper form. Upon filing, an application number and filing date are issued.

Examination

The DPMA conducts formal and substantive examination limited to absolute grounds, if objections arise, DPMA issues an Office Action, which must be responded to within the prescribed time limit.

Acceptance & Publication

If accepted, the mark is published in the DPMA Markenblatt (Trade Mark Journal). A 3-month opposition period begins for owners of prior rights to file an opposition.

Opposition Period

Third parties may file an opposition within 3 months from the publication date. Oppositions are based on earlier rights and are handled by DPMA.

Registration

If no opposition is filed, or if opposition proceedings are resolved in favor of the applicant, the trademark remains registered and fully enforceable. A Registration Certificate is issued electronically.

Validity & Renewal

A German trademark is valid for 10 years from the filing date. The registration may be renewed indefinitely for successive 10-year periods. Renewal must be filed before expiry or within a 6-month grace period with surcharge.
