How the Bhutan Trademark Registration Works

The Bhutan  trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

1

Filing

The trademark application is submitted in person or by post to the Intellectual Property Division in Thimphu.

2

Examination

The Registrar conducts formal and substantive examination to assess distinctiveness and conflict with prior marks. If objections arise, an official examination report is issued, and the applicant must respond within the stipulated time.

3

Acceptance & Publication

If the application is accepted, it is published in the Official Industrial Property Bulletin / Gazette, inviting third parties to oppose the mark.

4

Opposition Period

The opposition period is 90 days (3 months) from the date of publication.

5

Registration

If unopposed, and upon payment of the registration fee, the DIP issues the Certificate of Registration.

6

Validity & Renewal

A registered trademark in Bhutan is valid for 10 years from the date of application. It can be renewed indefinitely for successive 10-year terms by paying the prescribed renewal fees before expiry. There is typically a grace period after expiry with additional fees.
