EAEU Trademark Registration: One Eurasian Trademark for Five Countries

EAEU trademark registration lets you protect your brand in Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia with one unified Eurasian trademark. There is no central EAEU trademark office. You file one application, in Russian, with the national office of any member state.

Each member state office then examines the mark. If none refuses it, a single registration covers all five countries. The EAEU trademark is separate from the Eurasian Patent Organization (EAPO), which handles patents and designs, not trademarks.

Why register an EAEU trademark

  • One application for five markets

A single filing protects your brand across the Eurasian Economic Union. The union is a single customs territory with free movement of goods.

  • One registration to manage

Renewals, assignments and licences are handled once for all five countries, instead of five separate national portfolios.

  • Stronger protection against counterfeits

Goods move freely inside the EAEU. A unified trademark protects you in every member state, so infringing goods cannot slip in through a country where you are not registered.

  • Rights go to the first filer

Registration gives exclusive rights in all member states. Filing early blocks local registrations of your brand by distributors or squatters.

Our EAEU trademark services

End-to-end support from search to enforcement, through registered patent attorneys in the member states.

  • Trademark search

  • Trademark registration

Russian-language specification drafting, class strategy and choice of receiving office.

  • Office action response

Responses to objections from any member state office, and conversion into national filings if the EAEU application is refused.

  • Opposition

Filing third-party objections against conflicting EAEU applications, plus invalidation and non-use cancellation actions.

  • Renewal and recordals

10-year renewals, assignments and licences, managed once across the union.

  • Trademark watch

Alerts on conflicting marks in all five states, plus recording your mark in the EAEU customs register.

KazakhstanNational Institute of Intellectual Property (NIIP)
BelarusNational Center of Intellectual Property (NCIP)
ArmeniaIntellectual Property Office of Armenia
KyrgyzstanKyrgyzpatent

EAEU trademark registration process

Here is how to register an EAEU trademark, step by step.

An EAEU trademark moves from one receiving office to examination in all five states and back to one registration.

  1. Filing

The application is filed in Russian with the national office of any member state, which acts as the receiving office. It names the mark, the classes and the goods or services. Paris Convention priority can be claimed within 6 months of a first filing elsewhere.

  2. Formal examination

The receiving office checks the filing requirements and fees. It then publishes the application on the EAEU information portal.

  3. Third-party observations

After publication, anyone can file objections or observations for the offices to consider during examination.

  4. Substantive examination by every member state (7 months)

Each national office examines the mark on absolute and relative grounds under the Treaty, within 7 months of publication.

  5. Decision

If any office refuses, the receiving office issues a refusal for the whole union. The applicant can respond, appeal, or convert the application into national filings in the states that raised no objection.

  6. Registration

If no office refuses, the mark is entered in the Unified Register of EAEU Trademarks. The certificate issues after the registration fees are paid in each member state.

  7. Renewal (every 10 years)

The registration lasts 10 years from the filing date and is renewed for further 10-year periods.

File your trademark

Documents required for EAEU trademark registration

  • Power of attorney

In favour of the patent attorney, signed by the applicant.

  • Applicant details

Full name, address, and nationality or place of incorporation, in Russian transliteration.

  • Mark representation

Word mark text, or a clear JPG image for logos and stylised marks, with colours claimed if relevant.

  • Goods and services

Your list of goods and services by Nice class, in Russian.

  • Priority document

A certified copy with Russian translation, only if you claim priority.

Power of attorney requirements for foreign applicants (EAEU)

Foreign applicants for an EAEU trademark sign a simple power of attorney, normally without notarisation or legalisation. They must act through a patent attorney registered in the country of the receiving office. Responses to objections from other member states may need a local patent attorney in that state. Some payments are affected by sanctions, so we confirm a compliant route first. We send a ready-to-sign power of attorney the same day you instruct us.

Timeline, validity and renewal

How long registration takes

A straightforward EAEU application takes approximately 12 to 18 months from filing to registration without objections. An objection from any member state office adds time. Registration lasts 10 years from the filing date. It is renewed for further 10-year periods, with a 6-month grace period and a surcharge.

EAEU trademark law

The unified trademark is governed by the Treaty on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union. The Treaty was signed on 3 February 2020, and applications have been accepted since 1 April 2021 under its implementing instructions.

There is no central EAEU office. The national offices share the work and keep a Unified Register. Infringement and enforcement are handled under each member state's national law and courts.

EAEU trademark vs national filings vs Madrid

For brands entering several EAEU markets, the unified trademark is usually the most efficient choice. National or Madrid filings are safer when a refusal in one state is likely.

EAEU trademark National filings Madrid designating each state
Coverage All 5 EAEU states One country per filing The states you designate
Choice of countries No, unified Yes Yes
Refusal in one state Refuses the whole application; conversion available Affects only that country Affects only that country
Language Russian Local language of each office Madrid language of filing
Home mark needed first No No Yes, plus 5-year dependency
Management One register, one renewal Five separate portfolios Central at WIPO
Suits Brands targeting the whole union One or two key markets, such as Kazakhstan or Russia, or risky marks Portfolios already using Madrid

Use requirements and non-use cancellation

No proof of use is needed to register or renew. An EAEU trademark not used for 3 consecutive years can be cancelled. Use in one member state may be enough to keep it alive across the union.

Keep evidence of use: invoices, customs declarations, packaging and distributor records.

Objections, refusals and appeals

Objections from member state offices

Each member state office can object on absolute or relative grounds. The applicant responds within the deadline set, often through local attorneys in the objecting state. Third parties can also file objections after publication.

Refusal and conversion

If one state maintains its refusal, the whole EAEU application is refused. Within 3 months of a final refusal, it can be converted into national applications in the states that did not object. The original filing date is kept.

Appeals and actions after registration

Refusals can be appealed to the appeal body of the objecting state's office within the statutory period. After registration, invalidation and non-use cancellation actions are brought under the Treaty before the competent body of a member state, with effect across the union.

Trademark enforcement and infringement in the EAEU

An EAEU trademark is enforceable in each of the five member states, before their national courts and authorities.

What counts as infringement

Using an identical or confusingly similar mark for identical or similar goods or services counts as infringement. So do counterfeiting and importing goods bearing your mark without consent.

Your enforcement options

  • Cease-and-desist letter: a fast first step with importers, distributors and online sellers.
  • Unified EAEU customs register: record your mark so customs in all five states can suspend the release of suspect goods. National customs registers are also available.
  • Civil court action: injunctions, damages or statutory compensation, and destruction of counterfeit goods.
  • Administrative and criminal action: fines and confiscation for counterfeiting under national law.
  • Online takedowns: remove infringing listings on regional marketplaces such as Wildberries, Ozon and Kaspi.

Parallel imports

Russia currently permits parallel imports of certain branded goods without the owner's consent. Check the position before relying on your EAEU mark against grey-market goods there.

How Legacy Partners Global helps

Our EAEU trademark consultants coordinate customs recordals, cease-and-desist letters, marketplace takedowns and litigation through local counsel.

What to know before filing an EAEU trademark

  • Check Russian and local language meanings

A mark that is descriptive or offensive in Russian, Kazakh, Armenian or another local language can be refused.

  • Keep national filings as a fallback

For high-risk marks, file nationally in your priority markets, or plan to convert if the EAEU application is refused.

  • Plan payments and compliance

Some offices may be affected by sanctions and banking restrictions. We confirm a compliant payment route before filing.

EAEU trademark registration: FAQ

How long does EAEU trademark registration take?

Approximately 12 to 18 months without objections. An objection from any member state office adds time.

How much does EAEU trademark registration cost?

Fees are paid to the receiving office and to each member state office, in national currencies. We confirm the full cost, including our professional fee, in writing before anything is filed.

How long is an EAEU trademark valid?

10 years from the filing date, renewable for further 10-year periods.

Can I file one application for several classes?

Yes. EAEU applications can cover multiple classes.

Do I need a local agent or EAEU trademark consultant?

Yes. Foreign applicants must file through a patent attorney registered in the receiving office country. Objections from other states may need a local attorney there.

How do I choose an EAEU trademark consultant?

Check that they advise on EAEU versus national and Madrid routes and work with registered patent attorneys in the member states. They should also draft in Russian and quote fees separately.

Is the EAEU trademark the same as a Eurasian patent (EAPO)?

No. The Eurasian Patent Organization covers patents and industrial designs only. Trademarks are registered under the separate EAEU Treaty.

What can I do if someone copies my trademark in the EAEU?

Send a cease-and-desist letter, record your mark in the EAEU customs register, request marketplace takedowns or sue in the national courts.

Does the EAEU follow first-to-file?

Yes. Registration gives exclusive rights in all member states, so file before you launch.

Do I need to use my trademark before filing?

Yes. The application and the goods and services list are filed in Russian. Check how your brand reads in Russian and the other local languages first.

Can I designate the EAEU through the Madrid Protocol?

No. You can designate each member state individually through Madrid instead.

What documents do I need, and does the power of attorney need notarisation or legalisation?

A signed power of attorney, applicant details, the mark, your goods and services in Russian and any priority document. Notarisation and legalisation are not normally required.

Do I need to use my trademark before filing?

No. But a mark unused for 3 consecutive years after registration can be cancelled for non-use.
