UIBM is the national trademark office of Italy. Italy follows a first-to-file system and examines applications at the registration stage on absolute grounds. Applications may be filed directly with UIBM or through a registered agent or Chamber of Commerce. UIBM examines the formal requirements, including the applicant’s name and address, representation of the mark, and class list, and then conducts an absolute grounds review. Approved applications are published in the Official Trademark Bulletin, after which there is a 2-month comment period followed by a 3-month opposition period. If the application clears these stages, the mark proceeds to registration and a certificate is issued.

How the Italy Trademark Registration Works?

The Italy trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The application is submitted in Italian, either online through UIBM or in paper form. It must include a representation of the mark, the applicant’s name and address, and the full list of goods and services under the relevant Nice classes. If the application is filed through an agent, a signed power of attorney is required.

Examination

UIBM examines the formal requirements of the application and then carries out an examination on absolute grounds. A filing certificate is generally issued after formal review, usually within about 3 months.

Publication

If the application is complete, the mark is published in the Official Trademark Bulletin.

Comment/Opposition Period

Third parties may file comments within 2 months from publication, and formal oppositions may be filed within 3 months from publication.

Registration

If no opposition is filed, or if any opposition is resolved in favour of the applicant, the mark proceeds to registration and UIBM issues the registration certificate.

Validity & Renewal

Italian trademark registrations are valid for 10 years from the filing date and may be renewed indefinitely for further 10-year periods. Renewal applications may be filed up to 1 year before expiry, with a 6-month grace period available after expiry subject to surcharge.

Timeline

In routine cases, registration generally takes about 6–9 months. Formal and technical examination usually take around 4–6 months, although a fast-track option may reduce this to about 2–4 months. Publication and opposition stages usually add another 2–3 months. In a smooth case, registration is often completed in around nine months.
