Why Trademark Registration in the Afghanistan Is Important for Brand Protection?
Exclusive Rights: Grants you exclusive legal ownership and control over your trademark for the registered goods/services throughout Afghanistan.
Legal Enforcement: Enables you to take action against infringement, counterfeiting, and unauthorized use through the Afghanistan Central Business Registry & Intellectual Property (ACBRIP) and Afghan courts.
Nationwide Protection: Secures trademark protection across the entire territory of Afghanistan.
Market Positioning: Strengthens brand identity, builds consumer trust, and enhances competitive advantage in the Afghan market.
How the Afghanistan Trademark Registration Works
The Afghanistan trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
Trademark applications are submitted to ACBR-IP (Central Business Registry) in Kabul with the mark, applicant details, class of goods/services, and required documentation
Examination
ACBR-IP conducts formal examination for compliance and if requirements met then the applications move forward; deficiencies must be corrected. Applications covering goods or services that conflict with Afghan law or established social norms (such as alcohol, pork related goods) may face refusal during examination.
Acceptance & Publication
If the examination process is successful, the trademark will be published in the Afghanistan Official Gazette.
Opposition Period
Following publication, third parties may file an opposition within 30 days from the publication date
Registration
If no opposition is filed or if resolved in the applicant’s favor, the Registry issues a Trademark Registration Certificate. After registration, third parties have only three years to challenge your mark, after which claims become time-barred
Validity & Renewal
A registered trademark in Afghanistan is valid for 10 years from the filing date and may be renewed indefinitely for successive 10-year periods. Renewal applications should be filed within the last 6 months before expiry (no automatic grace period).
