How the Portugal Trademark Registration Works?

The Portugal trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

Submit your trademark application to INPI either online through IPI e-Services or on paper.

Examination

INPI conducts a formal check of the application documents.

Acceptance & Publication

Once formally accepted, the application is published in the Industrial Property Bulletin for public inspection and to initiate the opposition period.

Opposition Period

Third parties may file an opposition within two months from the publication date. After the opposition period, a decision to grant or refuse is issued

Registration

If there are no successful oppositions or refusals, and requirements are met, INPI proceeds with registration and issues the Registration Certificate.

Validity & Renewal

A registered trademark in Portugal is valid for 10 years from the date of grant. It may be renewed indefinitely for successive 10-year periods. Renewals must be filed in the six months before expiry or within a six-month grace period after expiry with payment of a surcharge.
