Trademark Registration Procedure in Poland

Here is the step-by-step process followed for trademark registration in Poland.

Filing

The trademark application is filed with the Polish Patent Office (UPRP) online via PUEUP or in person.

Examination

UPRP performs a formal and substantive examination, checking distinctiveness and compliance with law. Additional information may be requested if issues arise.

Acceptance & Publication

If the application meets all requirements, UPRP publishes it in the Official Bulletin of the Polish Patent Office.

Opposition Period

Once published, third parties have 3 months from the publication date in the Bulletin to file an opposition based on earlier rights.

Registration

If no opposition is filed, or if any opposition is resolved in favor of the applicant, UPRP issues a Decision to Register and, after payment of the protection and publication fees, issues the Trademark Registration Certificate.

Validity & Renewal

A registered trademark in Poland is valid for 10 years from the filing date. It may be renewed indefinitely for further 10-year periods by paying renewal fees within 12 months before expiry, or within a 6-month grace period with a surcharge.
