Thailand is a first-to-file jurisdiction and is not a member of the Madrid Protocol, requiring direct national filing. How the Thailand Trademark Registration Works

The Thailand trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

Filing

The Trademark applications are filed with the Department of Intellectual Property (DIP) either online or in person. All filings must be made in the Thai language. An application number and filing date are issued upon submission

Examination

The DIP conducts formal and substantive examination. Office Actions, if any, must be responded to within the prescribed deadline.

Acceptance & Publication

If accepted, the trademark is published in the Official Trademark Gazette issued by DIP

Opposition Period

Third parties may file an opposition within 90 days from the publication date

Registration

If no opposition is filed, or if opposition proceedings are resolved in favor of the applicant, DIP issues a Notice of Registration Fee Payment. Upon payment, the trademark is registered and a Registration Certificate is issued.

Validity & Renewal

Trademark protection in Thailand is valid for 10 years from the filing date. Renewals are permitted indefinitely for successive 10- year periods. Renewal must be filed within 90 days before expiry or within a 6-month grace period with surcharge.
