How the Kenya Trademark Registration Works
The Kenya trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
The trademark application is filed with KIPI, either electronically or manually, and must include all the details.
Examination
KIPI examines for formal and substantive examination. If objections are raised, an examination report is issued, and responses must be filed within the prescribed period.
Acceptance & Publication
If accepted, the trademark is published in the Kenya Industrial Property Journal for public inspection.
Opposition Period
Third parties may file an opposition within 60 days from the date of publication. If no opposition is filed, or if the opposition is resolved in favor of the applicant, the application proceeds to registration.
Registration
Upon completion of all statutory requirements, KIPI issues the Trademark Registration Certificate, granting exclusive rights over the mark throughout Kenya.
Validity & Renewal
Registration is valid for ten years from the date of application and can be renewed indefinitely for successive 10-year periods upon payment of renewal fees.
