Trademark Registration in Turkey- Protect Your Brand Nationwide

Trademark applications in Turkey are administered by the Turkish Patent and Trademark Office (TÜRKPATENT). TÜRKPATENT is responsible for the examination, publication, opposition, and registration of trademarks in Turkey. The trademark system follows a first-to-file principle and includes formal examination, substantive examination on absolute grounds, publication, opposition proceedings, and registration. Foreign applicants are required to act through a locally appointed Turkish trademark attorney

Why Trademark Registration in the Turkey Is Important?

Establishes Ownership: Grants you exclusive rights to your brand for specific goods/services in Turkey, preventing others from using it.

Legal Foundation: Provides a strong legal basis to stop infringers through lawsuits and claim damages,

Prevents Infringement: Allows you to take action against similar marks that could confuse customers, protecting your market presence, says Trademark Angel.

How the Turkey Trademark Registration Works?

The Turkey trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.

1

Filing

Trademark applications are filed electronically with TÜRKPATENT through a Turkish trademark attorney. The application includes applicant details, representation of the mark, and specification of goods/services under the Nice Classification. An application number is issued upon filing.

2

Examination

TÜRKPATENT conducts a formal and substantive examination on absolute grounds (distinctiveness, descriptiveness, public order, etc.). Conflicts with earlier marks are not examined ex officio but are addressed through opposition proceedings.

3

Publication

If accepted, the trademark application is published in the Official Trademark Bulletin.

4

Opposition Period

Third parties may file an opposition within 2 months from the date of publication.

5

Registration

If no opposition is filed, or if opposition is resolved in favor of the applicant, TÜRKPATENT issues the Trademark Registration Certificate.

6

Validity & Renewal

Turkish trademarks are protected for 10 years from the filing date and may be renewed indefinitely for successive 10-year periods upon payment of renewal fees.
