India’s Trade Marks Registry has opened a dedicated Special Disposal Drive to clear long-pending trademark opposition matters that are ripe for settlement or withdrawal. Under Public Notice Ref. No. TMR/Public Notice/2026/4546, dated August 31, 2026, the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) will hold hybrid hearings every working Friday from September through December 2026, giving applicants, opponents, and their advocates a clear, time-bound window to resolve outstanding India trademark opposition proceedings without a full contested hearing.

By creating a structured, recurring hearing slot dedicated solely to settlement and withdrawal matters, the Office aims to improve transparency and turnaround time in the opposition pipeline, while upholding the principles of natural justice for parties who still require a hearing on the merits.

Hearings are allocated by the filing year of the underlying trademark application, grouped into 10-year blocks, with each month of the drive dedicated to a specific filing-year range:

The drive applies to any pending India trademark opposition where the parties have reached an amicable settlement, or where either party wishes to withdraw the application or the opposition. Trademark applicants, opponents, and their authorized advocates or agents with matters falling into any of the four filing-year blocks above should identify affected cases and prepare to act ahead of the relevant month.

Filing Requirements Before the Scheduled Hearing

• Settlement deeds or withdrawal requests must be submitted at least 3 days before the scheduled Friday hearing date.
• Submissions can be made via the online IP India portal or by email to the Registry.
• Parties and advocates should proactively check the status of their opposition matters rather than waiting for individual notice.
• Hearings are hybrid: parties may appear physically at the Trade Marks Registry or virtually via the official link published on the IP India portal.

Consequences of Non-Appearance

The Public Notice states that non-appearance or non-compliance on the scheduled hearing date will result in the matter being decided ex-parte or on the merits based on the records available with the Office, applied in accordance with the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. Parties who do not act within the applicable window risk losing the opportunity to formalize a settlement on their own terms.
