Trademark Registration in Netherlands: Protect Your Brand Nationwide
It is the official registration office for trademarks and designs in the Netherlands (as well as Belgium and Luxembourg). BOIP handles national trademark filings under the Benelux Convention. It is a first-to-file registry. BOIP examines applications for formal requirements and absolute grounds. Once accepted, applications are published in the Benelux Bulletin. Owners of earlier rights then have a 2-month window to file oppositions.

Here is the step-by-step process followed for trademark registration in the Netherlands.
Filing
Trademark applications are filed with the Benelux Office for Intellectual Property (BOIP), either online or through an authorized representative. The application must include the applicant’s name and address, a clear representation of the mark, and a list of goods and services classified under the Nice Classification
Examination
After filing, BOIP examines the application for compliance with the formal requirements and also reviews whether the mark meets the legal conditions for registration. This includes checking the applicant details, representation of the mark, and the classification and clarity of the goods and services.
Publication
If the application is accepted, it is published in the Benelux Bulletin.
Opposition Period
Third parties may file an opposition within 2 months from the date of publication.
Registration
If no opposition is filed, or if any opposition is resolved in favour of the applicant, the trademark proceeds to registration and BOIP issues the registration certificate.
