The Malawian trademark system is grounded in English common law inherited from the colonial period, governed by the Trade Marks Act (Chapter 49:01) and modernised through subsequent amendments. Malawi follows a first-to-file principle. Malawi is a member of the African Regional Intellectual Property Organization (ARIPO), through which trademark protection can be obtained across multiple African states with a single filing under the Banjul Protocol — though direct national filing with MIPO remains available and in some circumstances preferable.

Opposition Period

Any interested party may file an opposition within six (6) months from the date of publication of the trademark application.

Registration

If no opposition is filed, or if opposition proceedings are resolved in favour of the applicant, the trademark proceeds to registration and protection extends to all OAPI member states including Mali

Validity & Renew

Trademarks registered through OAPI are valid for 10 years from the filing date and are renewable indefinitely for successive 10-year periods.
