Trademark Registration Procedure in Philippines

Here is the step-by-step process followed for trademark registration in the Philippines.

Filing

Trademark applications are filed with IPOPHL Electronically through the IPOPHL eTMFile system or manually at IPOPHL offices. An application number and filing date are issued upon submission.

Examination

A formal and substantive examination is conducted and if deficiencies are found, the applicant must correct them within the prescribed deadline.

Acceptance & Publication

Once accepted, the mark is published in the IPOPHL e-Gazette and in a newspaper of general circulation. A 30-day opposition period commences from the date of newspaper publication.

Opposition Period

Once published, third parties have 30 days to file an opposition.

Registration

If no opposition is filed, or if opposition proceedings are resolved in favour of the applicant, IPOPHL issues a Notice of Allowance and upon payment of the registration fee, the trademark is entered in the register and a Certificate of Registration is issued.

Validity & Renewal

A Philippine trademark is valid for 10 years from the filing date. Renewable indefinitely for successive 10-year periods. Renewal must be filed within 6 months before expiry. A 6-month grace period is available with surcharge.
