How the Netherlands Trademark Registration Works?
The Netherlands trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
Trademark applications are filed with the Benelux Office for Intellectual Property (BOIP), either online or through an authorized representative. The application must include the applicant’s name and address, a clear representation of the mark, and a list of goods and services classified under the Nice Classification
Examination
After filing, BOIP examines the application for compliance with the formal requirements and also reviews whether the mark meets the legal conditions for registration. This includes checking the applicant details, representation of the mark, and the classification and clarity of the goods and services.
Publication
If the application is accepted, it is published in the Benelux Bulletin.
Opposition Period
Third parties may file an opposition within 2 months from the date of publication.
Registration
If no opposition is filed, or if any opposition is resolved in favour of the applicant, the trademark proceeds to registration and BOIP issues the registration certificate.
Validity & Renewal
A Benelux trademark is valid for 10 years from the filing date. It can be renewed for further 10-year terms indefinitely.

Timeline
In straightforward cases, formal examination and publication usually take place within 3–6 months. After publication, there is a 2-month opposition period. If no opposition is filed, registration generally proceeds smoothly, and in routine cases the mark is usually registered within about 12–15 months. Under BOIP’s Express service, the process may be expedited, and registration can be obtained in about 4–8 months in uncomplicated cases.
