How the Laos Trademark Registration Works?
The Laos trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
The application is filed with the Department of Intellectual Property (DIP), either in paper form or electronically. A valid application must include the trademark, the applicant’s details, and the list of goods and services classified under the Nice Classification. If the application is filed through a representative, a power of attorney is also required.
Examination
DIP examines the application for both formal and substantive compliance. It reviews whether the application contains the required details, including the applicant’s name and address, clear representation of the mark, and properly classified goods and services. If deficiencies are found, the applicant may be required to correct them.
Publication
If accepted, the trademark application is published in the Official Gazette of Intellectual Property.
Opposition Period
After publication, third parties have 60 days to file an opposition.
Registration
If no opposition is filed, or if any opposition is resolved in favour of the applicant, the trademark proceeds to registration and the certificate is issued, effective from the filing date.
Validity & Renewal
Trademarks are valid for 10 years from the filing date and may be renewed indefinitely for successive 10-year terms upon payment of renewal fees.
