Filing
Trademark applications are filed with INDECOPI either electronically through its online system or by submitting the application directly to the Registry. Examination
INDECOPI conducts a formal examination to verify compliance with filing requirements. Once accepted, the application proceeds to publication. Substantive examination is conducted after the opposition period, assessing distinctiveness, legality, and conflicts with earlier trademarks
Acceptance & Publication
If the application meets formal requirements, it is accepted and published in the Official Gazette (Gaceta Electrónica de Propiedad Industrial).
Opposition Period
Third parties may file an opposition within 30 working days from the date of publication.
Registration
If no opposition is filed, or if opposition proceedings are resolved in favor of the applicant, INDECOPI proceeds with substantive examination and, if approved, registers the trademark and issues the registration certificate
Validity & Renewal
A trademark in Peru is valid for 10 years from the registration date and may be renewed indefinitely for successive 10-year periods. Renewal applications must be filed within the prescribed period, with a grace period available upon payment of additional fees.
