How the Malta Trademark Registration Works?

Filing
Trademark applications are filed with the Commerce Department either electronically through the IP online portal or by submitting the application to the Registry. The application must include applicant details, representation of the mark, and specification of goods/services according to the Nice Classification.
Examination
The Registry conducts formal examination to verify compliance with filing requirements, followed by substantive examination to assess distinctiveness, legality, and conflicts with earlier registered or pending trademarks
Acceptance & Publication
If the application satisfies legal requirements, it is accepted and published in the Malta Intellectual Property Official Journal for public notice.
Opposition Period
Third parties may file an opposition within three months from the date of publication.
Registration
If no opposition is filed or if opposition proceedings are resolved in favor of the applicant, the trademark is registered and a certificate of registration is issued.
Validity & Renewal
A trademark in Malta is valid for 10 years from the filing date and may be renewed indefinitely for successive 10-year periods. Renewal must be filed before expiry, with a 6-month grace period available upon payment of a surcharge.
