How the Indonesia Trademark Registration Works?
Exclusive Legal Rights: Grants you the sole right to use your mark for specific goods/services, preventing others from using it.
"First-to-File" System: Oman follows a registration-first approach, meaning the first to register usually has the stronger legal position, making early filing critical.
Protection Against Infringement: Allows you to legally stop counterfeiters and competitors from using similar marks, protecting profits and brand image.
The Indonesian trademark registration system follows a structured sequence of reviews, publications, and legal checks. These steps ensure that trademarks meet all statutory requirements and remain protected over time.
Filing
Trademark applications are filed with DGIP through a licensed Indonesian IP agent. The application includes applicant details, representation of the mark, and specification of goods/services under the Nice Classification. An application number is issued upon filing.
Examination
DGIP conducts a formality examination to verify compliance with filing requirements and classification.
Publication
If the application passes formal examination, it is published in the Official Trademark Gazette.
Opposition Period
Third parties may file an opposition within 2 months from the date of publication.
Registration
If no opposition is filed, or if opposition is resolved in favor of the applicant, DGIP issues the Trademark Registration Certificate
