English is the official language of government, commerce, and the judiciary, and all trademark proceedings are conducted in English.

Introduction

The country has maintained a modern intellectual property framework since the early 2000. Belize's trademark laws are codified in the Trade Marks Act, Chapter 257, Revised Edition 2000, which is based on UK law, and the Trade Marks Rules for procedural aspects. Belize is a member of the Paris Convention and the World Trade Organization (WTO), applying the TRIPS Agreement. Trademark registration is essential for any business operating in or exporting to Belize.

Critically, Belize operates its own national trademark registration system. Belize acceded to the Madrid Protocol on 24 November 2022, and the Madrid Protocol officially entered into force on 24 February 2023, making Belize the 113th member of the Madrid System. Belize is also a member of the Paris Convention for the Protection of Industrial Property (since 2000). This means trademarks may be filed directly with the national office or through the Madrid System designating Belize.

Trademark Registration Procedure in Belize

Here is the step-by-step process followed for trademark registration in Belize

Preliminary Search (Recommended)

While not mandatory, conducting a trademark search through BELIPO is strongly recommended before filing. A trademark study in Belize is a critical pre-filing analysis conducted to assess the registrability of a proposed mark under the prevailing trademark laws. The time required to complete the search is approximately 5 days.

Filing

The application is submitted to BELIPO, accompanied by the prescribed filing fee. Upon filing, the applicant receives a filing receipt with an application number and filing date. Multi-class applications are allowed for up to five International Classes per application.

Examination

Applications undergo both formal and substantive examination including conflict checks. The examination period is approximately 3 months.

Publication

If the application meets all formal and substantive requirements, the trademark is published in the Official Gazette. Publication is for opposition purposes, and the applicant is notified of the publication date.

Opposition

Belize has a formal opposition procedure. Third parties can oppose a trademark application for a period of 90 days (3 months) after the trademark has been published. The opposition period for international filings is explicitly three months. Any person may, within the prescribed time from the date of the publication of the application, give notice to the Registrar of opposition to the registration.

Registration Certificate

Following the opposition period, if no opposition is filed or any opposition is resolved in the applicant's favor, the trademark proceeds to registration, and a registration certificate is issued.

• Trade Marks Rules — the implementing regulations that detail procedural requirements.

• Trade Marks (Madrid Protocol) Regulations 2023 — the implementing regulations for the Madrid Protocol, which entered into force on 24 February 2023.

The legal framework is TRIPS-compliant and aligns with international standards through treaties such as the Paris Convention and the Madrid Protocol.

Competent Authority

Trademark applications are filed with the Belize Intellectual Property Office (BELIPO), which operates under the Registrar General's Department. BELIPO handles all aspects of trademark examination, registration, opposition, and record maintenance. Applications may be filed online through the BELIPO website or in paper form at the BELIPO office.

Belize is a member of the Paris Convention for the Protection of Industrial Property, the Madrid Protocol (since 24 February 2023), and the World Trade Organization (WTO), applying the TRIPS Agreement. Belize is not a member of the Nice Agreement but applies the Nice Classification in practice.

Validity & Renewal

Indefinitely renewable for successive 10-year periods. Renewal applications can be made within 1 year before expiry and are subject to payment of the prescribed renewal fee. A grace period of 6 months is available for late renewal, with payment of a surcharge.
